Armed eBay user 'wanted to talk' to auction winner


New Orleans man, Gerald Newburger, 44, was upset when he lost a 480-piece collection of second-hand matching band and dance uniforms to Robert Malinovsky of New York.

Malinovsky had placed the winning bid of $360, quashing Newburger's hopes of acquiring the uniforms to sell for a profit.

Despite the loss, Newburger resumed bidding offline by e-mail and phone with Malinovsky over several months, trying to convince him to sell.

When long-distance negotiations proved unsuccessful Newburger decided to try a face-to-gun approach.

Newburger allegedly broke into Malinovsky's home and threatened his wife with a Walther PPK .380 calibre handgun.

Malinovsky himself was not home at the time. No-one was injured during the confrontation and Malinovsky's wife called police after Newburger left - sans uniforms.

Detective Frederick Jankowski told the court it took him and two uniformed officers several minutes to calm the woman down so they could gather information about the man she said had entered her house.

He said the woman told him the man had walked into her living room, took a silver-coloured handgun out of a black briefcase and pointed it at her.

Then he showed her a piece of paper that contained a description of the band uniforms, Jankowski said, telling her he wanted to talk to her husband about them.

Officers apprehended Newburger in a taxi 30 minutes after the incident on his way back to the train station. The handgun was found in his briefcase.

Newburger, who admits to being in the Malinvosky home, denies he ever waved a gun at anyone. He claims the gun fell out of his briefcase when he reached inside it for a piece of paper.

Newburger is charged with burglary, criminal possession of a weapon, and coercion - if convicted, he faces a mandatory term of 5-25 years in prison.
