Contractors' Questions: Can I claim loss of earnings?
Contractor's Question: Have I got any grounds for claiming loss of earnings when I have terminated a contract early (1 week amicably) to meet the start requirements of the new client who subsequently did not honour the contract?
Expert's Answer: We would need to know if the contract with the second party was signed and, if so, whether the contents are the same. However on a general basis it is likely that if you suffered loss from the non-performace of a contact (if you can establish that a contract was in place) then you can claim damages for those losses. In this circumstance, the first steps for an IT contractor to take would be to a) determine if there is a contract (if not written and signed) and b) write a letter of claim to the party explaining your loss and giving them the opportunity to rectify the situation.
