    The reform is not retrospective. As was the case in the public sector, HMRC will focus on ensuring businesses comply with the reform for new engagements, rather than focusing on historic cases. HMRC will not carry out targeted campaigns into previous years when individuals start paying employment taxes under IR35 for the first time. Organisations’ decisions about whether workers are within the rules will not automatically trigger an enquiry into earlier years.

    Wishful thinking?

    You have to ask yourself why the projected tax receipts in the first year post implementation will yield a massive hike. My take on it is the retrospective tax grab, no matter what has been written/published.

    See page 38 point 54 Buget 2018 Red Book

    Expected yield for 2020-21 is +1,165 million but drops to +595 million in 2021-22.

      that document starts off correctly by identifying self-exmployed as out of scope for Ir35.
      And on the same page manages to confuse this by using the term 'self-employed' for Alan Example.

        Not simples

        "HMRC will not carry out targeted campaigns" - does not say they will not carry out campaigns
        "will not automatically trigger an enquiry into earlier years." - does not say an enquiry into earlier years will not take place

        So, basically, declaring yourself inside IR35 is providing precisely zero additional protection over previous years. Do it if you are inside, but don't do it because you think it might stop an investigation into earlier years.
