    IR35 & ltd company abroad

    I have a small one man Ltd company in UK working offshore, I live in Spain and have permanent residency, and commute every 2 weeks, Looking at the IR35 that will kick in next month ,which I think will destroy contracting all together unless you ditch the Ltd company and go with an Umbrella Company which again for some will also be a disaster.
    My input on here is to try find a way to remain a Ltd company work offshore uk waters pay my taxes as I have been doing, in UK but be out off payroll, as a contractor I don't think the clients I work for want to employ direct so it would mean no more work?? My line of thought here is could I register a Ltd company in Spain and work offshore UK. Don't know what others think but the IR35 is going to cause mass destruction in one foul swoop.

          Your biggest problem is no more expenses

          Gross rate * 52% = new rate

          Then take your flights and accommodation and women = heehaw

            If you commute and work in the UK you need to register your business, whether that is a UK Ltd or a Spanish company in the UK and you are subject to the rules. Therefore setting up a Spanish company will make no difference. Currently EU rules allow you to work via a Spanish company. Next year it will probably not be possible. If you are within IR35 then you can simply use an umbrella.

            If you work remotely then you can use a Spanish company without having to register in the UK and tax yourself in Spain. In this case you wouldn't be subject to IR35. You would be able to attend business meetings in the UK.

              Google "Beckham's Law". If you fit the criteria, engage a Spanish immigration lawyer and Tax Specialist.
              I was an IPSE Consultative Council Member, until the BoD abolished it. I am not an IPSE Member, since they have no longer have any relevance to me, as an IT Contractor. Read my lips...I recommend QDOS for ALL your Insurance requirements (Contact me for a referral code).
