Failed Larsen Howie IR35 SIFT (Deemed Inside) vent warning

I know it's all academic thanks to the delay but I've got to say the Sift questionnaire gets my goat big time. I think I buggered up on one detail out of the myriad of questions. Substitution. I mean let's face it, in the real world how can a 1 man band ltd who has a niche skill be able to substitute themselves. It's meaningless. I could lie or I could be honest. Why should I have to lie? The end client gives me no preparation or guidance on how I'm meant to run my affairs, as a contractor it feels like I've just been tossed to the sharks.

I specialise in technology for goodness sakes, not pseudo bullsh1t thrown at me by Larsen or HMRC. Time to pack it in and go back to school. And give me my bloody holiday pay whilst I'm at it.

So should I bet 99.999999999% of other contractors. And the accountants that are going to fall on their arses too. Hope everyone fails out of this mess especially HMRC.

Is it true your accountant was COV19 patient zero?

The point of substitution is about your right to put one in.
The likelihood of you finding someone suitable is immaterial for the purposes of IR35.
If you answered the question knowing (well thinking, as your view of niche might not be true) you can’t find someone that may well skew the result against you.
