    Non-Payment from EBT scheme

    Hi

    Recently took on my first contract and used an umbrella EBT scheme for payment. The umbrella company is now no more and the EBT scheme has 2 months of invoices which they are refusing to pay me (not committing to a date or plain lying when I will be paid). The EBT scheme has a new partner in the UK but I have not moved over, I have my own LTD company now.

    Lesson has been learnt! Does anyone out there have advice how I can pursue the EBT company for the money that’s owed to me?

    Define "owed". You gave them your money in the expectation of getting a return. Since they are offshore, and the new onshore partner has no commitment to the previous one's debts, you may have a problem.

    I suggest you need legal guidance here, not our inexpert musings.

      Totally agree with Mal on this one - your legal position will depend on the contractual arrangements that you had with them - you will need specialist advice

        In a way I think your lucky. In my view going into an offshore umbrella is a mistake. I would recommend anyone to steer clear of any of these schemes.

        Good luck in getting your money.

        If I were you when you get your money I would just tax it "normally" and have done with it, and not have it as a loan. These schemes just hang around your neck like a millstone. It doesn't feel like a mill stone in the beginning, as you get high take home, but rather like Scrooges chains, the millstone gets heavier and heavier.

        I suppose a some contractors still haven't been bitten by whatever scheme they're in, but I think the number that are bitten grows by the day.

          Yes get advice.

          Also make sure you clarify their stance.

          Are they refusing to give you the money or are they just saying that doing so will incur a PAYE and NI burden?

                me 3 they owe me £4k, Edge are giving me a load of Bull about how he doesn't have my details in front of them and he can't tell me how much or when they can pay me.

                today Edge told me to go back to my top level agency and get them to claim the money back from Norla as a creditor - why i was getting paid by Edge not Norla, my payslips are all Edge nothing to do with Norla.

                i just see this as they are trying to bull 5hit me out of my money as they think they can run with it and no one will get them as Norla have collapsed

                  HI I am also chasing money owed from Edge! This week I have been told by Edge they will not talk to me unless I sign a non-disclosure agreement. They say this is because there are commercially sensitive issues involved! I have pointed out they are my employer and should be able to speak to me. They did say that they would decide if, when and how much I will get paid.

                  The problem is not only the getting the money its getting the P45.

                  On friday Norla Norla no longer answer the phone and have a message saying they have ceased trading and their website has been removed.

                  Does anyone want to join forces to take legal action to pursue the money?

                    I managed to get my money from them before they blew up, but I'm still waiting for a p45. If they never send one, does anyone know what else I can do? I know they are legally bound to do so, but I'm guessing that means nothing to them based on how they work...
