    Allegis/Tek: Interesting Contract Term

    Just got an extension in the form of a new Schedule: Project Details.

    The wording includes

    The Company shall provide the following, non-exclusive resources in support of the Specified Services:
    • One or more Consultants will lead the project on behalf of the Company.
    • One or more Personal Computer systems ...
      etc


    I must ask my agent whether anyone has ever brought along other consultants under such a contract

    What you should be is how often. Someone might have but in a vast majority they won't have. You know many contracts are worded just to be IR35 friendly so I wouldn't get over excited when another sham clause appears that looks good.

      I agree these are all sham clauses but my accountant always says "But the point is an employee contract would never ever have those words in - so you are not an employee".

        Well, it makes me feel better...
        That's nice. Just make sure you put it through QDOS and get a pass for contract and working practices. That would make me feel better.

          I have the same contract from Allegis on my current gig. Been through QDOS and it passed with flying colours.
