The Department of Immigration and Border Protection, however, said Mr Lee had previously received a notice of "consideration to refuse his visa application", and had responded.

Mr Bernard's visa application was refused on character grounds after he was convicted of three drink driving charges and two driving without a licence charges when he was a teenager.

He was also charged with obstructing a police officer after he was wrongfully detained at a Perth music festival three years ago in a case of mistaken identity.

"I accept when I was younger I lived for the weekend out on the drink," he said.

Mr Lee said he understood why his visa had been refused, and accepted he had "some dark patches" in his youth.

"That's fine, I'm prepared to leave – but I'm not happy with the fact that I have to sit in detention for the next three months in order to be allowed to leave when I want to and I already have a flight booked next week to leave the country," he said.

What is really rather pathetic is that a piece of policy has been poorly executed and the "argument" then becomes that the policy itself is poor and therefore wrong.
