I didn't think tax avoidance was illegal, as opposed to tax evasion....

If it is legal in the country then no its not illegal for the company to use the deals to make such arrangements, however within the EU it is illegal for governments to make such laws. There are 3 parties involved and 2 transactions Company-> Luxembourg = legal, Luxembourg -> EU = illegal.
