    Hello peeps!

    I've got a new role! ( )

    This one I got from LinkedIn, the end client (a fairly large company) want me to go through an agency (Hays). Going through all the on-boarding kerfuffle I ticked to remain opted-in to emp. regs.

    The lovely lady from Hays is checking back to make sure that's correct, it's no problem she says, she'll just prepare the paperwork if I want to stay opted-in.

    But the agency didn't introduce me to the client, so aren't I automatically opted-in?

    You can't opt in: you are in unless you and YourCo specifically and correctly opt out. Ignore Hays' tick box nonsense, it's too late to change things anyway.

      The rule is 'Introduction OR SUPPLY'.

      Agents will manipulate this rule to suit themselves without any care for why it was worded like that.

      The Conduct of Employment Agencies and Employment Businesses Regulations 2003

      hirer” means a person (including an employment business) to whom an agency or employment business introduces or supplies or holds itself out as being capable of introducing or supplying a work-seeker;
      But all that aside. This is all you need to know

      Ignore Hays' tick box nonsense, it's too late to change things anyway.
