    Termination of Contract - help wanted

    Can anyone out there advise me on what course of action to take on termination of my contract.

    I was offered a position for 6 months and accepted it but after 3weeks they have terminated the contract with no real plausible reason. When I started I had a particular purpose and then that all changed and we were asked to work completely out side of contract requirements on a completely different task. Does anyone know what course of action would be approiate in this situation as I had also forked out for flights and hotels.

    When you say 'contract requirements', I am assuming you mean that you have a standard agency contract, but that you are referring to the nature of the work involved during the contract duration.

    If thats the case, then its probable that you can only study the termination clauses to see if there's any breach. Otherwise, welcome to contractordom.

    For one thing, its a golden nugget of evidence that you in business on your own account - a piece of courtroom mileage against IR35.

      My point being that standard contracts rarely discuss the nature of the work in detail - certainly not as far as captured requirements.

        Sorry, I seem to be doing a bit of Agile iterative development on my response.. forgive me for slowing down the whole interweb.

          Put it down to experience and move on. We don't get paid more because the clients are feeling generous; we get paid more because they can ditch us at any time with no plausable reason.
          Will work inside IR35. Or for food.

            Look at the termination notice period. If there is one you can ask for that to be paid, or simply invoice it. However there may be clauses that allow instant termination. Basically, do not expect to get anything other than the days worked.

              I had a bit of that a few years ago. A whole load of us got canned. I was pleased to come home. How far away are you.?

              What a couple of the guys I was with did was found something else out there. They had accommodation booked and paid for so they had a bit of a holiday and found some more work (Telecomm Boom)

              Not much you can really do. No point in hanging about if they ain't paying.

                Was there a notice period in the contract?

                This happened to me a few years ago when I was given a months notice after 2 weeks. I had previously done several years great work for this very large pharma company. This included designing a document/image management system for them using a leading content management system. The system worked a treat and was rolled out across the World. It was a good system.

                The second contract was in the group that ended up supporting that system. Basically, they got rid of me because they had an easy job doing sod all until they had that new system to support and so got there own back by getting rid of me. Just remember there are some complete b*******s out there and most of them are afraid of a proper days work!

                So ask your agent to find you a new contract.

                I haven't looked back since! :-)

                    HI,

                    this has just happened to me today. Started a contract last Tuesday for a major on-line gambling site, and I went in today to be took in the office after 30 minutes, some implausible reasons given for gross misconduct, terminated contract and escorted out of the building. Funny thing is they had a permanent DBA start on Monday...

                    I have contacted the PCG Legal helpline and they have informed me that they are in breach of contract and to seek the assistance of a solicitor to claim for the whole term of the contract and not just the notice period. Hopefully going to see one tomorrow. Anybody know of any good commercial and contract solicitors??

                    Turns out that I might have picked up work straight away but also told that it doesn't matter as it was a company to company so it is loss of revenue....

                    As an earlier poster put - good for the IR35 argument if it crops up..
