    Beating the tax man

Is using a baseball bat classed as evasion or avoidance?

I think it depends where... apparently the stomach area doesn't bruise as easily, also if you spray them with a hose first it helps.
    B00med!

When does your case come up in court?

I do hope Mr Brannigan and his HMRC chums are reading this.

I'm far too slippery for that.

Depends upon whether its use is "wholly and exclusively required in the performance of the business".

If he's invading your home, then that's now legal, so is avoidance. However if you set a trap or beat him whilst running away, then that's evasion.
Will work inside IR35. Or for food.

So if we don't play baseball and don't beat people in our spare time we are safe?

Yep. You can also invoke your substitution clause and have "Shoeless" Joe Jackson (other baseball players are available) to help with any IR35 issues.
