    Over payment

    I work (Permie)for a small financial institution. I got told a couple of weeks ago that they'd over paid me about 5k over the past two years. Apparently my pay slips made reference to these extra payments as some form of allowance but I only ever look at the amount I'm due, if that, not the details. Can they discipline me in any way?

      No. I'd also say anything prior to April is safe as in a previous tax year.

      Just tell them its thier **** up so they can pay for it.

            I have heard something about three years - meaning, within 2 years, yes, they could insist on it back.

            As only £5K (a weeks contractor money) - is it really worth falling out with your employer?

            Wait there - isn't £5K a whole 3 months of permie money? Oh dear, credit crunch and losing £5K - time to emigrate fella. Either that, or, hire a hitman for the boss you want to do away with - £2K should cover that, meaning you are boomed by £3K........

            More useful answer - have an adult chat, and agree to either drip pay VERY slowly and leave ensuring all hols are taken, or, pay back agressively and get it out of the way

              Ah but Paddy, I'm a contractor who used to specialise in payroll systems. So I do know a little background.

              They can certainly take the money back off you.

              As for disciplining for dishonesty, in theory yes (probably - it also depends on your employment contract) but only if they really thought you knew all along.

              But it's a smallish amount over a long period so you can reasonably say you didn't realise there was a mistake, especially as your payslips are as you say. And they would have to accept that really, because it was their mistake and they didn't realise it for 2 years either, even though getting your pay right is their specialism and their responsibility. It's not as if there was a whacking great extra payment 1 week that should have rung alarm bells.

              Usually they will accept that their mistake is now causing you quite a bit of inconvenience (you've been living on x + £5k and now you've got to start living on x - £5k) and any thoughts of disciplining you for not being eagle eyed and spotting their mistake will fly out of the window.

                  Then again since going contracting I've had nothing but first class testimonials and clients extending me two or three times.

                    Contact the employment tribunal for one of their forms. It's dead easy to fill in.

                    Fill it in saying they have stopped the allowance they agreed to give you three years ago because your boss has taken a grudge against you because of your colour / religion / gender / sexuality / his drink problem. Go to the doctors and say how this is making you feel really stressed and you're not sleeping. See if you can get signed off for a week. Then don't go back.

                    Then claim for constructive dismissal.

                    Worst case: a huge lump sum in about two years.

                    Best case: a small lump sum in about a month.


                    (Jeez. As a contractor you really do have to do EVERYTHING for the permies, dontcha?)
