    Anti Competition Clauses Advice.

    Hi Guys,

    Interesting situation here. 10 of us guys work for one of the big agencies in the UK, however work in a different European Country. We hate the agent as he is ripping us off and in general providing a bad service. He is taking a pretty big rake from us and is non negotiable. We want to get rid of him and have approached the clients about this who are happy to oblige in our request. They are now going to talk to their legal department about sacking the fool. We signed the usual anti competition clause, that for four months we can't work for the company after we leave the agency etc. What are the implications and the different scenarios. Anyone out there experienced this before and acted upon it. We are going to be offered contract extensions and we want to stay with the company but not through the same agent.

        1) What country are you in, sometimes local laws forbid a restraint clause.

        2) The margin is always negotiable, particularly from the client side. Are you the only contractors on site or does the agent have any competition? You guys all presumably signed up for whatever rate was offered so it must be possible to get people at that rate. If that's 50 Euro/h and the client's paying 100, then that's 30 Euro times 40 times 45 times 10, that the client is paying that he doesn't have to. I'm sure that the client would like to save half a million Euro.

            Go and see an employment law expert, get their view of the situation. You will need them if the agent gets angry and goes after you. The cost of defending this action will be less if you acted on the advice of your lawyer in the first place.

            Don't be tempted to do this without consulting a lawyer you'll get screwed. And a lawyer will only charge about 200 quid to give you all the details you need to make an informed choice

              Did you opt in or out of the employment regulations?

              If you opted in, you can do direct and forget about the agency.
