    Is it better not to have a notice period on your contract from the IR35 point of view?

    If you cover one of the three major points it shouldn't really be a deal breaker, but it certainly helps prove there's no MOO if you can walk at any time (or be booted out at any time).

    It's having one months' notice on either side that tends to be a pointer toward employment as this is what an employee would expect.

      A huge IR35 employment pointer is not having a notice period \ termination clause, it's where the clause goes on to mention money in lieu of notice. This is what permies have if they are sacked ie money instead of working the notice.
