Getting out of a wedding - advice for friend

A friend (no really not me!) has just broken off her engagement just over 4 months in the future. Apart from everything else, the venue are saying she has to pay basically the entire fee - they were doing it relatively cheaply on their own money but it's still £4000. She paid £500 deposit which is obviously gone but apparently it's booked in her name alone.

It sounds pretty mercenary to demand the full fee this far ahead to me, but what should she do? Just tell them where to get off and leave them the deposit? Make a big song and dance? Go and cry in front of the organisation so they feel bad?

I haven't yet seen any contract/paperwork/T&Cs she agreed to but I'd think this is more about negotiation than strict contract wording?

Even if there was a contract to that effect, I'd chance it and let them try and take me to court over it. Chances are those sort of terms aren't enforceable.

They'd have to prove they actually lost out. It's unlikely that they will get away with claiming that 4 months wasn't enough time to find another couple to hire the venue.

It seems slightly harsh to demand the entire fee. Losing the deposit is a given, that is what they took it for.

There might be a clause in the contract stating that she is liable for the full fee if she cancels after a certain date? Otherwise I think she should just tell them she will not pay it, if they threaten court action then wish them luck.

I see no reason why she is obliged to pay it, they are probaby just trying it on.

Check the paperwork for cancellation dates. And even then reply sue me for it. then add by the way I'll play the poor innocent party in the press.

The local rags love this kind of story especially if the person is photogenic. It takes a lot to fill the Northern Echo daily.

Yep. I mean the £4k aren't going to be just the costs of hiring the venue - it'll be the cost of hiring the venue and them providing the decor, the ceremony, meal, reception, etc. They won't be doing any of these things, so there's no way they could claim the full £4k and get through with that at small claims.

Mind boggles that some people are out there hiring a venue for a day for 4K when the relationship isnt even stable. I hope you dont lose much money Dhoog, my sympathies.

Deffo trying it on, 4 months to go and they want the full fee. Feck Off!

Tell them no way, if they push it then try some of the suggestions in the earlier posts.

I guess it was stable when they booked it. That's what engagement is for in my book; far better than getting stuck in a marriage!

I knew a couple who were engaged to be married and before the marriage the girl went off to Nepal on some holistic trip or something where they all meditate and things like that. Anyway she came back and it was days before the marriage and she decided he was not the right guy. They even had a 2 week honeymoon booked in Canada.
