ContractorUK has received a solicitor's letter on behalf of White Collar Financial Limited and would like to clarify some details.

This thread does not state or imply that White Collar Financial Limited run, or have ever run, an Employment Benefit Trust (EBT.) This forum was set up so that individuals who have received letters from HMR&C querying their tax returns could discuss their options. Presence of company names in this or other threads on this forum are not an implication that these companies run, or have ever run, an EBT scheme.

Having spoken to several of the posters on the forum who used ASMG we are aware that some contracts who used the services of ASMG went on to use the services of White Collar Consulting.

The fact that some people moved from ASMG to White Collar Consulting is in no way a connection to show that the two companies were linked in any way.

White Collar Consulting Limited is a dissolved company but we would like to point out that White Collar Financial Limited (Company Number 07109682) is a solvent, actively trading company at the time of writing this post.

I've had the dubious honour of receiving my lovely brown envelope yesterday for 2008/09. :sick

I've noticed in the long thread a few people affected that have been with ASMG & White Collar (though disconcertingly less numbers than other companies)...

Add me to that list. I would also welcome being in touch with others and perhaps we could exchange some of our own experiences and issues.

I have also indicated that I will be attending the conference hosted by Michael Perry, however I would appreciate being given PM permission by the Mods so I could formalise my intentions.

Hi HAM, just a note to point out that White Collar has NEVER run any scheme that has 'E*Ts' anywhere associated, No Sirree.

Never.

Wouldn't dream of making that association.

Just thought I'd point this out and ask you all NOT to use that naughty (and incorrect) reference.

ASMG 2005/06 and 06/07 COP8 enquiries, nothing heard for almost 5 years now. No reply was requested, so I have not replied to HMRC.

Good news, then really! Sorry for you to have had to go through it though - not sure what a COP8 is, but it certainly sounds bad....

This Code of Practice explains how the Fraud and Avoidance section of the Specialist Investigations directorate of HM Revenue and Customs (HMRC) carry out investigations. It applies to all investigations where the Civil Investigation of Fraud procedures (Code of Practice 9) are not used.

COP8 = HMRC investigations where they do not suspect tax fraud
COP9 = HMRC investigations where they do suspect tax fraud

Yep I have got a letter as well for 2008/09 having been with white collar so waiting to see what happens next. Will send a letter of appeal which I found on the Edge EBT thread and look to attend the conference mentioned here. Finding it difficult to understand how the retrospective charging can be made on something that was not illegal

I’ve also been with ASMG and White Collars for 5 years (I am still with White Collars) and I got a letter from HRMC for 2008/09.
Talked to Patrick and Kaite this morning and they will send me a letter to reply to HMRC.
When I asked them why this is happening (the scheme is supposed to be legal and approved by IR) and if HMRC will take us to the court they both assured me that the scheme is legal and HRMC can’t take us to the court. They also told me that if they do so they will act on behalf of us!

I had my letter through yesterday. I will be calling White Collar tomorrow Morning to see what they have to say.

I am sure they will try to reassure me and tell me not to worry and that they will represent us if it goes to court but I fear these may be empty promises just to stop existing clients from jumping ship

Yes, that is my concern also, they were adament that they would provide support for anyone who was with them at the time in question irrespective of your current status. I expect we won't really know until the point in time that it is required, if it is required.

I am in that same boat, got the dreaded 08/09 letter, but lost 14 days due to snail mail to Australia.

Does any one have a copy of the WC letter so I can meet the 30 days Appeal time line?

I also need a phone number for White Collar that works!

Got a letter back this morning confirming receipt of the suspension.
They have argued in the letter they can't be prevented from using discovery and also that it was taxable income.

They will consider why section 29 can't be applied to and also evidence to show that this income wasn't taxable.

Not sure what happens next.

Hi there,

I have gone and seen a tax lawyer last week and they opened my eyes up to a few valid points:

1. Get as many people using your tax efficiency scheme together as possible now - 80 to 90 people would be recommended because:

a. They are 99.9% sure people will have to pay - cases ARE being lost against HRMC hand over fist in the courts at the moment. Wasn't the Rangers case was won on a technicality - the Rangers players weren't actually named beneficiaries of the trust, their family were?

b. You don't want to go to court - I was told I would most likely loose. Tax court cases are 1 - 2 weeks and cost an average of £250k. Do you have those kind of finances?

c. You don't want to be a low hanging fruit - individuals who are easy to pick off.
Get a group of people together - 80 to 90 who have the resources, paying £1,500 rather than £250,000 and the right representation so that it gives HMRC pause - to go after easier pickings. You will still have to pay but HMRC may defer dealing with you later and give you a bit of breathing space. I don't know about you but I certainly don't have the money sitting around that they are currently asking for.

b. Timeframe: HMRC are currently prosecuting the 2003 tax year - best case scenario is four years before they take you to court, worse case 2 years and most likely case 3 years.

c. How much you pay. A larger group might be able to settle the tax bill at a slightly decreased rate.

d. Is your provider telling you not to respond to HMRC?, do you realise that you may incur a penalty fee up to 100% of your tax & interest bill if you aren't seen as co-operating. What you say or do to co-operate is something you should talk to a lawyer about.

e. If its taking three years for your case to be heard at trial, do you think your provider (or the company who is saying they are completely separate to your original provider but are saying they will stick by you?!?!?) will still be around or will have closed shop. Where are they getting the money to front one, two, three...... £250,000 court bills from? did they know the tax efficiency scheme they were promoting was dodgy and had these spare funds sitting around for this day to come? are they going to up and close shop leaving you completely stranded having not prepared any defence for yourself because you thought they were going to take care of you?

f. What kind of proof do you have about how your tax efficiency scheme was set up. Org structure of the companies involved, how they inter-operated - the renumeration setup and where they said you were in the scheme and how to prove you were setup how they said you were setup. All this kind of information is required for anyone to represent you in court.

The tax department can serve a section 36 on any company that they want to get more information about you on, your bank, employer, provider - the tax investigation departments are specialists and will find out everything.

I will be seeking a second opinion on the lawyer I went to see but right now my main objective is to get as many people together as possible - why not hedge your bets even if you don't believe this is the right solution, Lets get everyone together so we can share info and decide on the next action.

This is not about going after the promoter/provider of the scheme. This is about being in the best possible position to defend yourself come judgement day - I implore all of you to get each others contact details now rather than wait till its too late and you have no information and no way to defend yourselves.

Hi Mickey - Thanks for the post.. I also think it is important that we set-up a group so that we can work with HMRC collectively and also provide a forum that we can share experiences and support each other. I imagine that we are all in a similar situation, so it makes sense to look for a collective representation (noting that HMRC may look to bind us to the decision of a test case rather than as individuals) should this proceed to tribunal and as you say there is a safety in numbers and certainly better representation will have a massive impact.

If you look at the first post on the Cascade thread by Costo - I think this provides a sound example of how we should proceed, particularly with the idea of a private group (I would certainly join, although i don't really know how to go about setting something like this up).

I believe it is too soon to start thinking about starting a legal fees war-chest (so to speak). But we should certainly have the ground laid should the need eventuate.

You've raised a few salient points here from your chat with the legal respresentative and whilst I think it is very much a case of plan for the worst, but hope for the best, it is also too soon to draw any measured conclusions until HMRC have provided a formal response to the appeal, expressing their technical reasoning behind the decision (which I understand they are legally obliged to do). This is the point (for me atleast) when I think legal advice will be most helpful.

Under the DOTAS rules, I was under the impression that all avoidance schemes had to be disclosed to HMRC and referenced to on our tax returns.

However, looking over my old tax returns, I can't see the scheme reference number highlighted anywhere. Where on the tax return should this scheme reference number be?

Hi, just new on here having just received a Late Payment Surcharge Notice from HMRC for 2008/09 in relation to 'unpaid tax'. This is the first letter I have received indicating any potential 'issues' for that tax year. Nothing else has been received, although as I live in Oz mail could have gone AWOL on its way over here. I was with White Collar for just under 3 years. So what next? Looks like White Collar Financial is now dissolved but also seems people are still talking to them? And the big question is - what will be in the post for the subsequent tax years as the 4 year deadline for them approaches?? I take it they are working their way forward year-on-year to meet with the required timescales?

I think that it is highly likely that you are missing some correspondence from HMRC that predates the Late Payment Surcharge Notice, such as an assessment of tax for 2008/09. HMRC are advising you that they have added a surcharge for non-payment, as you have not paid by the due date of the assessment.

I would strongly urge you to make contact with HMRC as soon as possible, to establish your position and to avail yourself of any missing correspondence that you have not received.

There is an online service called Government Gateway that you can sign-up to and view your self assessment account remotely. I have recently signed-up to it as I am also on the other side of the world and I can see my tax account all the way back to the early 2000's!

Thanks for you reply. I spoke to my accountant today (my current accountant that is, not the one I used while with White Collar) and he told me he did receive a letter from HMRC about the re-assessment. The letter stated that a copy had been sent out to me (the one that never arrived) and as this was before I was his client he assumed I would pick it up. He's going to get a copy emailed to me tomorrow when he's back in the office. In any event I called HMRC today but they were unable to help as the case is with a specialist department. He's noted the fact that I called re missing correspondence and is going to get the relevant dept to contact me. When I get a copy of the original letter tomorrow I'm hoping there will be another number or reference no I can use. I am of course going to get an appeal letter to them (awaiting a template now) and can only hope they accept the appeal given the circumstances. From what I understand at this stage there is no guarantee that this tax will be payable, as this will depend on the outcome of the existing test case appeal the revenue have raised. But like others have said, best to plan for the worst and hope for the best.

I was going to ask how I can contact White Collar but I see that Under the Cosh has provided a URL so thanks for that, much appreciated. I left White Collar back in 2010 when I moved down under so their website etc has changed.

Any more news on any of the members forming a collective group? I'd be interested in joining if there has been one set up.

Hello fellow vicitims, I live overseas now so I only just got the letter through (along with several thousand in late-fees) - I've contacted white-collar and am waiting for a reply.

I'm about to take my first contract with White Collar, will I be okay (I'm told I can't get a retrospective tax bill as it's tax planning and not tax avoidance), can anyone confirm that it's safe as a little concerned after seeing some of these comments?

How can I tell if it’s tax avoidance?

You are entitled to plan your tax affairs in a way that makes sure you do not pay more tax than you have to. There are many legitimate ways in which you can save tax, or example by saving in a tax-free ISA (Individual Savings Account), making donations to charity through Gift Aid, claiming capital allowances on assets used in your business or paying into a pension scheme. But there is a big difference between using tax reliefs and allowances in the way in which they are intended to be used, and trying to bend the rules to avoid tax.

There are warning signs you can look for which should help you decide whether you are being offered good tax advice about how to plan your affairs or whether you are being sold a tax avoidance scheme.

I imagine everyone will start receiving letters for 09-10 shortly.

Just a quick note and reminder to yourself and anyone else with White Collar assessment notices - we have set up a private group for discussion, support and eventually to help crowd fund any resultant legal action down the track.

If you want to PM Turnover - he will give you the relevant details (please be patient, as obviously administering a group is not his primary vocation).

my and my fellow contractors r very lucky that we are being supported by the company you enrolled us into the scheme. If ASMG / White Collar are not supporting you then form a group asap and find a account as well. Remember you will not be able to win against HMRC if you are unable to provide the details of how your structure functioned. From what I know (and I am not expert) that many of these schemes were based on solid legal ideas but fell short of proper implementation. Many did'nt do what they said on paper and did not follow the correct procedures. The sooner you form a group, sooner you can start finding out details of how solid was the implementation of the scheme. Don't wait too long start a google+ or any other online group and only let people join after verification.

White Collar can help you with your appeal. Also, if you are hard pressed time-wise because of the distance, give HMRC a call (no seriously - I can give you the relevant numbers via PM if you need). In my dealings with the case officer she was very understanding and professional (for me, my assessment notice was lost in the mail and they put a note on my file to acknowledge my intention to appeal, even though the actual letter may well be received by HMRC outside the 30 day window).

Personally, I have not received anything further regarding my case since the appeal was accepted, but I expect this to change through 2014.

Lastly, we do have a group and would encourage you to join. If you want to request PM rights from the CUK admin team and PM Turnover, he can provide instructions from there (although please be patient).

Hello guys, I was also a contractor and I am about to join the party :smile I received a phone call from the HMRC Debt Collection Department regarding the tax year 2008-2009 and Kirium. As I moved since my last known address, I didn’t receive the original letters and I suspect they have applied a surcharge. I really would like to join the group and discuss further.

Hello guys, I was also a contractor and I am about to join the party :smile I received a phone call from the HMRC Debt Collection Department regarding the tax year 2008-2009 and Kirium. As I moved since my last known address, I didn’t receive the original letters and I suspect they have applied a surcharge. I really would like to join the group and discuss further.

XContractor - First and Foremost, you need to sort out the current issue, which is to negotiate with HMRC and get your appeal to the judgement accepted.. otherwise this is a legal debt that you must pay (and HMRC have been very aggressive of late - even pushing people into bankruptcy)..

Once this is done however, your next step is to wait for HMRCs next move. Will the case go to Tribunal - likely, but not certain.

My advice - sort your appeal (as an aside, get yourself a HMRC Gateway account if you haven't already, it means you can update your address and see your accounts online); join our support group and make sure you have all your documents (original tax returns, P11Ds, trustee contracts; trustee emails/comms etc) and keep them handy

Hi Zarkana

This isn't uncommon (it takes HMRC more than a few weeks to process the appeal, but provided it was in on time there is no dramas)..

I checked mine the other day and had the same, but made a quick call to HMRC and they confirmed it had been received (there's a phone number and case number on your assessment)

Some people will say it won't count if everyone sends similar letters but HMRC will have to report to the Minister how many responses they got. So every letter does count.

Just a reminder that this weekend is your last chance to respond to the proposed legislation on ‘Tackling marketed tax avoidance’.

As you probably know, the Government intends to introduce an accelerated payment measure which will give HMRC the power to link your tax affairs to another person's case and demand money up front, with no right of appeal.

If HMRC are granted these powers, it will allow them to demand almost immediate payment of disputed tax before you have had the chance to have your case heard at the tax tribunal (FTT).

If you do one thing this weekend, be sure to spend 10 minutes firing off an email to ask that these proposals are rejected. This is your last chance, so don't bury your heads in the sand!

I was with WC for a couple of years and have received the 2008/9 and 2009/10 letters from HMRC, and appealed as per WC instructions. I have found the advice and discussions with them over the last year very useful.

Reading an article from Contractor UK this week (How Budget 2014 impacts contractors :: Contractor UK (http://www.contractoruk.com/news/0011481budget_2014_how_contractors_are_affected.ht ml?utm_source=NL&utm_medium=News&utm_campaign=Budget)). This has me worried as it says even with accepted appealrs, HMRC can now demand the disputed amounts upfront.

Anyone with thoughts/insight into this?

Got my invitation to settle letter through today like others.

Has anyone spoken to White collar recently? I haven't since last year but notice a post here since saying they are closed now. Their website is still running so that's a good sign?

Offices are closed on Saturday rang the number and got a recorded message from the building owners. None of the numbers seem to be working so not looking good. Previously I'd dealt with Patrick but his email is bouncing back now.

I have just received a letter from HMRC about the use of an off-shore tax scheme I used between 2006 and 2008. Since 2008 I went to Network One and then I have my limited company.
The off-shore company was called Assignment Solutions (ASMG) and I was paid by Tenon, Marra to name but a few off-shore companies based I'm guessing in the Isle of Man. At the beginning the consultant kept advising the tax scheme was legitimate and close to a similar one used by footballers and HMRC a like. They quoted a well known law practice and QC barrister and HMRC tax reference. So even though I felt sure it was bordering inside the law I did still feel it was close so hence the move to Network One.
The letter was received today Saturday so I have two gruelling days to wait before I can talk to HMRC.
ASMG went on to become White Collar Consulting both of which seems to have ground to a halt but there is questions whether ?.. <mod snip: please read the first post on this thread>
My question is, how do I contact ASMG or White Collar Consulting and gain access to their records, who will look after my request, am I on my own?
I am the full membership of PCG and use Bauer and Cottrell too but what do I do?
Any answers would be greatly appreciated.

I would emigrate but i love blightly too much.

Yes, I got the same letter that you mention today, but mine says clearly on the first page that it is for the tax year to 5 Apr 2011. Are you sure yours does not say the same?

Thanks mate - have had email contact with Turnover just waiting for acceptance to the group now.

On a separate note - white collar is very much still running. However their email system seems to be a bit flakey at the moment bouncing back emails. But their telephone numbers are working and they did say they are very busy at the moment but if you need to talk to them just keep trying till you get through.

Oh dear, there seem to be a few of us don't there?

After my last comms from Hector in 2009, I got the CLSO letter everyone is raving about last week completely out of the blue, but I was away on holiday so only read it properly today. Have yet to make my way through the Q and A attached to it, but expect that to be one-sided "advice".

So I'm here for proper advice please if anyone has any tips or suggestions.

I was with ASMG for about 3 years in 2006 to 2008 although I do need to dig up my records and check. I have had two letters relating to the tax year 2007 and 2008 which merely stated that an enquiry had been opened, but no further action was required from myself. So I didn't do anything.

The question is what to do now! From my previous attempts to get help and info from ASMG or the IOM companies I don't expect any help from that quarter this time round either.

There is a lot of PM-ing going on, so if at all possible dear Moderator may I be allowed the privilege too?

I too was with ASMG and have received the letter. I have PM'd all suggested and nobody appears to have setup an ASMG group… please let me know if this is not the case?

Please be aware that the CUK forums and the Google groups are completely separate. CUK Admin can give you Private Message (PM) privilege to CUK, it is then for you to contact turnover regarding the Google group.

Take independent legal advice on what your options are that is the best course of action. There is a group of former members of the schemes mentioned in this thread, PM turnover here if you are interested.

Any Ideas as I have sppoken to my current accountant and he seems to think I have no choice but to pay it. As for a Tax expert what kind of cost? Has anyone been able to contact White Collar and what have they had to say about this new demand. PM if you have any ideas please.

Has anyone got a copy of the letter that HMRC sent out (on at least 3 occasions as far as I can remember) saying that the scheme was being investigated. It was a generic letter about the scheme not a specific one relating to your own figures.

I'm sure I saw a copy on a thread on this forum - but can't remember where it was and searching is throwing up too many results.

Hi,

I've just returned home to a letter for the tax year ending the 5th April 2013.

I was with White Collar at the time. HMRC are asking for a check under section 9A of the Taxes Management Act 1970 where they believe that I have entered into contractor loan type avoidance arrangement.

Should I be here, or asking under another thread?

Apologies if I'm in the wrong place, but all I can seem to find for WC are letters for 2009 etc.

I've spent two hours reading here and I'm non the wiser. So please don't think I'm just being lazy if I'm on the wrong thread.

Yeah they were moving offices yesterday, I spoke with them and was asked to forward a copy of my letter so they could prepare a response back for me today.
