I am being taken to court

A woman pulls out of her lane whilst I am overtaking and hits my car. A bit of damage so I said to her to leave it and call it quits. 4 months later I am being sued for £1000 and accused of "colliding with her car". I have a scrape along the nearside door which is not too serious. croydon court for me in Feb 2014.. food parcels welcome. She said I was going too fast (it's a Ferrari luv what do you expect?) and has clearly got a point to prove.

I have had an "exchange" with her lawyers trying to tell me what to do - nothing annoys me more than these people.

Perhaps if you can bribe two references she'll lose the court case.
And what exactly is wrong with an "ad hominem" argument? Dodgy Agent, 16-5-2014

Well, you'll have your day in court. Embarrass the bitch by asking when the speedometer on her car was calibrated and can she present the certificate?

Call her and her lawyer's bluff, and have them take the matter to court. Don't use a lawyer yourself. You'll probably win.

Question is has Dodgy told his insurance company. If not he's into a world of pain for not having the evidence that he reported the accident....

If the lane was clear when you pulled into it and she pulled out in front of you, it's her fault - that's what mirrors are for.

It's going to court now, fault has nothing to do with it.

Insurance companies assert blame in part by looking at the point of impact. I am not sure what a court would do, but if you would have gone through your respective insurance companies, they would have looked at the point of impact on both vehicle to a ascertain whether you drove into her or whether she pulled into the side of you.

One would imagine that forensic people could tell roughly how fast you were travelling based on the scrapes/scratches
