Suity, when people talk about opting out, they are generally referring to the Conduct of Employment Agencies and Employment Business regulations

      - This gives protection about things like getting paid, reasonable handcuff clauses etc.

      Here's Egos take on it

I think it's pretty much a given that the AWR don't apply to contractors working through a limited.

Its a given that we automatically bypass AWR as we also have an intermediary between ourselves and the agency (i.e. a limited company or umbrella)..

I think they do apply to umbrella workers.

            ...

You can ONLY opt out of the Conduct Regs, you cannot opt out of the AWR, you are either in or out and if it is not obvious or you argue one way or the other, an employment tribunal cand decide for you.

If you opt out of every contract (where there is an agent), you have to sign a form, if you go back to some of them and read them, you will see that they refer only to Conduct Regs.

If you work direct, the Conduct Regs are irrelevant.

The AWR was as the heart of my dispute with previous Clientco. They tried (and failed) to enforce AWR.

Back of the subject of Alexander Mann.

I contracted through them a couple of years ago and the payment terms were odd. From recollection my invoices were paid every 2 weeks, assuming they were signed off in time, but there was an initial 'bedding in' period before this cycle kicked in. May well have been 30 days, but once done, it was every 2 weeks.

Maybe it's something like weekly invoicing with 30 day payment terms so your first invoice is paid after 37 days and then you are paid weekly (30 days in arrears) after that?

We pay everything that becomes due over the Christmas break before we leave on Christmas Eve.

Running SAP and an automated timesheet system its actually not difficult.
