    Risk Annoying Agent and Client By Delaying Start Due to Contract Review?

    The agency has drawn up a contract for a gig to start which In currently having reviewed by an IR35 specialist. I received the contract on Wednesday which they want signed ASAP to enable me to be "set up on the pay system" in time for next week. Sent contract for review on Thursday and received a reply that it will be reviewed by close of business this coming Monday. However my start date is Tuesday, the following day.

    I pre agreed a start date with both the client and agency to fit in with a handover from the previous contractor. However I already know that there will be amendments to make on the contract and there is no way that I will be able to get these done between close of business and the next morning!

    What's the best way to deal with this? I already emailed my agency initially requesting more information and an amendment whilst the contract is being reviewed. The reason being that there are no payment frequency terms specified on the contract, which is odd and no schedule apart from a role title more junior and to what I had been interviewed for and what was advertised, but have received no reply. I'm feeling a bit dubious already but at the same time I don't want to annoy the end client....

    Contact the client asap explain that the agency has missed out important clauses from the contract and until they are added in you cannot start as you won't be insured.

    Also if the agency doesn't respond to your emails in a few hours you need to ring them up and ask them if there is a problem. Don't just leave it.

    Both are true especially if you have IR35 insurance.

      Who did you send the review with. If it was QDOS get on the phone and explain the situation. Not often than not in these situations they pulled a blinder and got it done very quickly. That should at least buy you a couple of hours. Should really have paid for the day turn around in this situation but it's still salvageable.

      How many days handover have you got with the other contractor? An extra day or so shouldn't really be a problem. Bit of grumbling at first but should disappear as quickly as it occured.

        I had exactly this issue earlier this year and conidently stated I couldn't be online until the agency had done their bit.

        By this point I had client's number and email address so let them know as a matter of courtesy - and apologised on their behalf.

        The delay didn't last too long after that!

        Little tip - when you get to the point where the final pass is ready make sure the start and END date are updated so that you don't lose out on work due to starting late.

          This +1, especially as you already knew the urgency. In reality you had plenty of time.

          In fact, outside of finance, you are lucky to get 3 working days, prior to starting, without negotiation.

            Unfortunately I don't have the clients contact details. The handover is for 4 days only next week including the original start date. The review is being done by an IR35 review team as part of Clearsky accounting. I've used them a number of times before and their turnaround is usually within a couple of days max.

                As already suggested look at linkedin. The latter is helpful if you can't quite remember the names of the people.

                Google for main reception number - I've had to do that many times. As long as you have the address you can get the phone number.

                The client website sometimes also show you the format of the company's email addresses. I've also guessed the email addresses of client staff. It does help if the person doesn't have a common name.

                  At the outset, did you convey the urgency to them?
                  With my Mrs first contract, admittedly fast tracked, by Qdos, it was done in a few hours?

                    Usual crap from agency. They dont care if the contract gets sorted or not. In fact, most of the time they'd rather it wasnt because if they can get you to show up then its a done deal and they dont have to listen to contract queries.
