    For those deemed outside IR35 after April: what if HMRC disagrees?

    Getting many different opinions on this. Is it recommended recommended getting insurance in such case?

    I'd get the insurance before they disagree

    If client says outside and HMRC says inside then, technically, it's the client who has to cough up. That said, I wouldn't put it past HMRC to find a reason to chase you for some cash too.

      Yeah, in case I'm definitely getting insurance then. Looking at lower rate but well, gotta keep paying the bills.

        Your insurance won't cover you for the client's liability.

          If the Conservatives win a majority then I fully expect the rules to be changed in the first budget. So I would hold off worrying about it until after we find out the result.

            Really? Is there anything in particular that leads you to that conclusion? All I've seen is what all the parties are doing - answering the question with what they think people want to hear as they know there's no level of accountability required in what they're doing.

              It's not about the liability, it's about the costs of arguing about it.

              It's highly unlikely you'll get tax protection if there is any doubt about how likely it is to be used. That's the case now, it will be even more so after April.
