    Important: If you are a Sanzar, Garraway, Winchester, Darwin and/or IQ scheme user

    As you may be aware, HMRC are currently conducting enquiries into certain schemes. Sanzar, Garraway, Winchester, Darwin and IQ are among many other schemes that are affected by these enquiries. For Sanzar initially they have requested a large payment is made back to them by each of their users based on a retrospective recalculation of their tax liability.

    Under new legislation approved in 2014, HMRC will be able to issue Advance Payment Notices (APN's) for money that they believe is owed to them. Under this new APN concept we will have to pay up the amount within 90 days of receiving this notification without a right to appeal.

    We have created a private group where all affected and potentially affected scheme users can join forces to appoint a tax specialist/law firm that will help us understand what our rights are and where we stand legally.

    It is important to understand that even if you have not yet received enquiry letters you most probably will in due course and we need to ensure we all come together in order to have some sort of chance of getting a fair treatment.

    In order to become part of the private group you will need to provide proof of having been part/or being part of any these schemes.

      I can confirm Pinsent Mason are not supporting a group of Sanzar scheme users.

        What is the situation now because it looks like these crooks (which they are) are going to get their money?

        Things were rosey way back 2008-2009 and prior to that date but times have changed and I no longer work in IT and quite honestly out of the work as I write this message.

        I have until the end of July to make a full payment which I obviously can not pay and as I understand you have a further 30 days in which case they will add 5% and this goes on for how long I do not know, so I'll find this amount increasing beyond any reach and selling the house is not an option.

        I'm sure they are others in my predicament.

        Any advice would be appreciated

          This group and the BIG GROUP

          Hi all,

          I am aware of this group, however I have joined the BIG GROUP as I don't have the lump sum to stump up at the moment for this group. The BIG GROUP upfront cost at £50 and then a monthly payment is more manageable for me. However I totally understand the need for the upfront payment on this group.

          What I am not clear on is whether both groups will be fighting the same issues?

          Does anyone have a clear view of both groups? I don't give away any information that I shouldn't!!

            The BIG GROUP exists to find common ground and argument across all schemes and to identify and promote particular analysis to HMRC for the benefit of all.

            That work may (passive tense not imperative) identify a means to delay APN's.

            However, any APN due before say the end of May is unlikely to benefit and needs to be dealt with individually.

            I'm aware that some providers have "template" letters requesting delay whilst representation is made. I've not seen these but can guess at some of the points.

            I do NOT have a template letter. BIG GROUP does not have a letter.

                HMRC way

                Hi,
                Im new to this and Im not sure whats HMRC is trying to get out of this APN issuance and etc.. Well it's money ofcourse!

                I think Human rights does not cover UKs tax governance as it is individual government's jurisdiction (so they say) when it comes to tax matters. Does that mean HMRC can pull ideas out of air and just throw them at individuals to get what they want to? Most of these promoters now changed their names and vanished in to thin air and I feel they were either intimidated by the HMRC or were given some incentives to disappear, I know I cannot prove it, so cannot HMRC. By the way HMRC if you're eavesdropping these threads (who am i Kidding), did you realise that all the EBT loans are payable in 56 years as per small print? So I guess HMRC will have to wait and see if all EBT users (DOTAS as per HMRC) would be paying off these loans in that time. You know all this APN issuance is going to go wrong big time with negative implications to the HMRC in long term and to the APN recipients in the short term. A personal tragedy in relation to APN is all needed to get HMRC to go wrong at all levels with hefty penalties from the courts as this APN regime may not meet the legalities that HMRC did not consider (im not giving away) in hurry.
