HMRC wed site clearly states they will noot seek to make people bankrupt unless as a lst resort, i.e. if they can get money form any other means they will peruse with Bankruptcy.

HMRC issue briefing: disguised remuneration charge on loans - GOV.UK

also in the same briefing, in section 5 state :

"Since the loan charge was announced, HMRC has agreed settlements on disguised remuneration schemes with employers and individuals worth more than £1 billion. Around 85% of this amount was collected from employers, with less than 15% from individuals."

is this correct 85% has been collected from employers?!?, has anyone had any experience in which the employer i.e. scheme operator or umbrella company associate with the operator has settled any ta due on the loans?

They would refuse to tell you if you asked. That figure is misleading anyway as in most cases the employer to HMRC is the ltd company / sole director contractor, not the scheme promoter

The data is false because it includes not just the mass marketed loan schemes sold to contractors but the EBT/EFRB type schemes used by a lot of owner managed limited companies to extract funds from a business.

Both arrangements include as a feature, a loan from a trust.

Thus a company owned by one or a few people, settling with HMRC is classed as an employer settling.

It's more smoke and mirrors designed to deceive the eye of MPs who are too stupid, lazy or scared of the party whips to do their job properly and examine not just the law they make but its real effects on real people.
