    Not quite, there was a debt originally (as that was how the schemes worked as otherwise you would have had to pay income tax at the time).

    The questions you need to find out are:

    1) is there still a debt (i.e. it's not been written off)
    2) whether it's time expired
    3) (and if it is still valid) who owns the debt at the moment...

    Q1 and 2 a decent solicitor should be able to answer for 3 you need to ask Felicitas in a way that doesn't accidentally result in you validating that debt...

      To be clear - this is my position - I'm just a contractor who saw through the schemes because had the internet not appeared as I graduated in 1994 it is incredibly likely that I would have become a tax specialist and would have then created such schemes - it's the type of devious thing I enjoy designing (but I do it with software instead).

      As for anyone thinking I'm part of Fecilitas - it would require a time machine to pull that trick off.

        They don't want it to go to court as they have a good chance of losing. Remember this isn't their first shakedown, this is just the lastest one. They would also lose their anonymity as a lot of people would be interested in that case. The emotion involved by the general public would be huge. Especially in this current climate, where massive amounts of people have lost their livelihoods. Then you have these wealthy cockroaches trying to frighten normal working people to part with their hard earned cash. They might have the mask of being a successful business man, but that will be stripped. Their families and friends would be shunned and judged. Their lives would be forever disrupted. Then there is also the chance they go to jail and or have to pay back any monies received. The con would be dead. They aren't going anywhere near a court.

          If Felicitas cannot prove the debt exists and that they own this debt, what exactly are you paying them your 5% for?

            1) Covid is an excuse for a delay - no more no less and it allows Felicitas to ramp up the pressure.

            2) The one thing you never ask a solicitor who loves getting money from going to court is, is it worth going to court? The answer will only go in the direction of their wallet.. Now court cases may not be kicked off, it's another of those gambles you have to decide upon.

            3) No I answer points as I see them - I suspect the issue is that you don't like my replies

            4) That sadly isn't what I'm seeing, what I see is an echo chamber which may potentially be encouraging people to fight on without checking whether the debts are valid, not time expired and so Felicitas may actually have a case.

                Have you? They can enjoy that freedom because Joe public doesn't know them. Malta has a huge British expat community and it doesn't take long to have the media vilify you in a huge courtcase, which this would be.

                  I don't think I've ever said anything about paying - my advice until now has been dispute in a way that doesn't admit or accept anything.

                  With the current offer I'm no longer so sure, partly because of etc tax's comments but mainly because it's been 6 months and it's definitely approaching the end game. When that offer disappears 1 of 2 things will occur, Felicitas will either give up or they will double down and I haven't got a clue what they will do. If it's 1 then the money has been spent for no reason, if it's 2 then the 5% offer (with confirmation that everything is written off) will be a bargain compared to the final cost. And I know the money involved isn't small sums but the amount at stake is potentially far larger.

                  Finally what has the FCA and their guidelines got to do with a debt that has nothing to do with them (EBT and loan schemes were never in their remit) - I'm sure I pointed that out over 100 pages go.

                      I wouldn't count on this. The vast majority of the general public won't have much sympathy at all, and probably close to zero interest. "You're a tax dodger and you got involved with the some dodgy people and you knew what you were doing. Tough tulip" is how the general public will see it.
