Old Umbrella Company (Tailored) in Liquidation

A letter composed by a solicitor detailing assets and liabilities will help show the liquidator that you are officially unable to pay and then where they take it from there will be very limited I imagine.
In court the judge would laugh the contract out of court. Poorly written and who in their right mind would agree to work for minimum wage, who would loan these amounts of money to people only earning an apparent 12,500 per annum. Totally BS.
So if you have it in writing that the advance would not be repayable (amazing)
If you have more debt than assets (amazing)
Group action for those who do not fall in to the above categories is a good idea but wont reduce the cost that much unfortunately. What would be good is if a test case was put forward and won then the rest of the case should be much easier to defend and will probably just fall away.
I would say to most people who don't have the money...don't worry yourselves. I owe £20k+ and to be honest when you take it all into account I have 5k of debt when its all balanced up so they cant take what I don't have. I will have HMRC to pay I am sure but it will be at an agreed amount per month.
Ask a solicitor to provide a letter detailing the assets and liabilities should only cost about £250-500 depending on the solicitor.

    Good luck.

      Something doesn’t add up

So I’ve been reading the threads as I had another email today from ‘Management’ again asking me to reach out to <Person 1>. When I first received the letter from Voscap, I was initially quite startled.

Once I had composed myself and dug a little deeper, I found it interesting that Voscap looked like it has relatively recently been set up. Trying to track down any of the key figures was very difficult. They had no LinkedIn presence (although <Person 2> has had a profile created, it wasn’t there in June) and neither did any of the named individuals on the letters. These individuals seemed to be based on existing LinkedIn in profile that had been slightly altered. They all seemed to have triple-barrelled names and the legal person (<Person 1>) seems to be a ghost operating out of serviced offices.

As someone else mentioned, websites were under construction and initially Google searches brought up nothing, requiring you to use links provided in emails. The Voscap website looks fake (where are client testimonials?) and the pictures of the offices also look like they’ve been bought off of Google images. Has anyone on this thread had any direct evidence presented by Voscap? Has anyone thought of going to their offices in London to see if they even exist? Something else that I had also noticed is that the name on the letter sent out is of <Person 2a> yet on the website, his name is<Person 2>.

There are no news articles relating to Voscap or any references than the letters that we have all received. Today’s email makes me think that follow up letters are in the post, I would advise everyone to respond to this by having an independent solicitor draft a response requesting more information and proof, and sending it to Voscap. Spending £200 now is a small price to pay for piece of mind.

Personally, I believe it is a scam and they are fishing to see who blinks. Remember, a lot of us worked through agencies and there is no question that money passed from the company of employment to the agency to Tailored. We all have proof of this and can demonstrate that payment was not made to us until after it had been paid to Tailored negating any evidence of these payments being loans.

Are they inferring that we were working only to provide Tailored with out earnings? I self certified with HMRC, so if there is a delta in what I paid them vs what I should have, I’ll take me chances with HMRC but then I only worked through Tailored for a two months.

        Same situation here

        Hi there,

Am in similar situation except have not received a letter. Have a received an email with Voscap and Matthew being involved as well.

However, last year I was approached by HMRC as part of an investigation into Tailored to provide a backlog of information. Have decided to go to HMRC as a first port of call to try and get some information about what the results of that investigation were and how they might relate to this liquidation case.

Anything I learn, I will share.

        Thanks

Still waiting to hear from HMRC

          Have chased again.

Question, has anyone been chased or made a payment yet?

Curious as usually these have 28 days notice and we've gone way past that for some people on this thread

Hello Nervous Newbie, I am in the same situation as you and would like to talk

Hello Newbie, I am the same as yourself and in need of legal representation - do you have anyone, as per WTT, suggest - beyond them we would need legal help. I've had a demand repayment letter needs answering by Friday!

I see some said Freeths- does anyone know whether they have got a few contractors together.
I hope you will come back to me with this genuine request for mutual discussion and help. Thank you MoX8

I’ve moved this post as it made no sense where MoX8 posted it originally.

MoX8 - What was the umbrella company you were using called?

If it's Felicitas you need to speak to WTT as they seem to be looking at using appropriate specialists - etc have walked away (confirming my theory about them)

Sadly it's something I cannot prove and proof won't be available (unless they were incredibly stupid).

So I will not say it in a public forum (nor likely outside this forum).

I realise you've kindly posted the above because it may be helpful to others in the same situation.

However, you may want to consider deleting it because the liquidators may also see it.
