    Old Umbrella Company (Tailored) in Liquidation

    Help!

    I've received an email from the Director of my old Umbrella Company stating that they have gone into liquidation. To put things frankly it was a dodgy umbrella company which used a salary advance as an additional payment. I left as soon as I realised the error of my ways and I am in the process of sorting my tax affairs with HMRC.

    The Director has stated in the email that the liquidators MAY ask for repayment of these salary advances. They have then forwarded details of a specialist solicitor which he feels I may need if they do pursue these repayments? I did not receive any more money than my hourly contract rate.

    Surely they cannot do this? Wanted to gain some sort of legal perspective and understanding of what is happening here? Any advice would be much appreciated.

    Can you name the umbrella and the solicitor?

    I suspect that if the umbrella is dodgy, the "solicitor" will be a company closely associated with them who are attempting to get more money out of their victims.

      the devil is in the detail.
      Read the contract you had with them. What does it say? Was the 'advance' a loan? If it was then you may well owe it back.

        Umbrella company: Tailored UK Serviced Limited/ Tailored Resourcing and Accountancy/ Tailored Services
        Director: Brendan Beeken (Who has been appointed and removed a number of times through company history)
        Solicitor: Matthew Whyatt, Wilber Smith is the firm but he also acts as Director at ASW Solicitors

        This is the impression I got. The email has a link to a website for ASW solicitors it takes me to a website in construction page. His email is an ASW solicitors domain. Phone number is a personal mobile. Very dodge!

          The contract doesn’t mention the word loan anywhere. It just says a salary advance made against future earnings.

            So it's a loan then. Secured against further earnings. Simple. They were not simply giving money away. From what's been said here, I think you were unwittingly using a tax avoidance scheme disguised as an umbrella company.

                Simply put I would not trust ANY advice, company or person that these people 'recommend'.

                They all have their noses in the same trough - find another company.

                  I’m in the same boat. I got an email from this this evening saying the same thing. Not sure what to do yet but I certainly won’t be using their solicitor.

                    Hi

                    I’ve received an email regarding the same thing, that TAILORED is now in liquidation and that the liquidator is basically going to come after contractors for their salary ‘ advance ‘ . HMRC are aware of Tailored and are treating this as a loan / tax avoidance so if you have not already best to get an accountant to approach them and it is likely we will have to pay tax that they never did through this scheme. The solicitor they suggested appears to be dodgy one man band and no doubt affiliated with Brendan Beekan.

                    If anyone knows of a good set of solicitors they are using, please let me know .
