    It's the age old issue with HMRC enquiries, they have a view and no amount of letter writing or rational argument will sway that.. If you don't agree you're only avenue is to appeal to Tribunal.. so it just comes down to whether the tax bill is large enough to justify getting the lawyers in..

      Being blunt that's how HMRC work - they have a list of names with amounts of taxed owed on them, and unless you move heaven and earth to show why they are wrong nothing is going to change that figure because that person's performance review is based on ideally HMRC receiving that sum of money or at least it not disappearing from that list..
