    Offer to settle sent but nothing received back

    Has anybody else had the problem where they sent back the offer to settle in time but never received anything back?
    I sent mine in time and I even received a call a couple of weeks later in the 1st week of Sept asking if I received the payment options letter. They asked this because they said they were having issues with people not receiving them.
    I confirmed I had not received mine and was told not to worry as they would chase up and call me back.
    Then a couple of days back I received the letter that I had not paid in time and had to go the loan charge route.
    I called them to complain to which I got the response there was nothing they could do even though they had it on record that I have told them I have not received my letter.
    I was then told to complete my tax return and follow the loan charge route.
    I have asked for it to be escalated and also emailed in my complaint.
    Any suggestions to get this resolved?

    Ask your Member of Parliament to intervene on your behalf.

    MPs routinely take on public bodies, like HMRC, on behalf of constituents.
    Scoots still says that Apr 2020 didn't mark the start of a new stock bull market.

      I wrote to my MP 2 weeks ago as HMRC have taken over 2 years to get my settlement calculation correct despite several attempts and them admitting their errors (they even paid me £50 D&I compensation a few months ago for raising an assessment on a year that had already been settled!). They still haven't managed to get it correct to date and havent replied to me since May this year. All I've wanted to do from day 1 is pay up, settle and move on with my life.

      I had received acceptance last year and paid my settlement based on a calculation HMRC provided. They later decided that they had made an error and that I owed a higher sum even though full details had been provided from the start. They then provided a new calculation (without factoring in what I had already paid in settlement) so when asking them to provide a new calculation which included payment already made, they seem to have twiddled their thumbs for 4-5 months despite several letters and phone calls asking for an update and being told "we're very busy but you'll hear from us soon"

      Not sure where I stand now, whether I'm supposed to pay the loan charge on the excess. Whether HMRC still expect any further payment or will eventually decide that as I settled and it was accepted and paid, that the loan charge doesn't apply and that a separate settlement will be calculated for what they deem to be the extra amount. Goodness knows but its one massive screw up and it's entirely their fault! My advisors don't seem to have a clue either so it's totally in HMRC's hands.

      I haven't even had a reply from my MP in 2 weeks so not expecting much help there!

        Are you saying that they'd accepted your offer to settle and you'd paid the settlement figure in full? Surely, they can't just come back and say that you owe them more if you'd been honest and declared all your loans to them? Otherwise, what is to stop them coming back every few years demanding more money? In my naive view, surely this needs to go to tribunal?

          HMRC had originally classed the scheme as self employed but after settlement they decided that I should then be classed as employed through my limited company so sent a new calculation to my ltd company which hasn’t factored in what I had settled personally.

          Sorry I should have been clearer. Still not an ideal scenario though!

            So after complaining, HMRC called me back and confirmed they have on record that I mentioned not receiving the letter. They then also confirmed that they did not send me a copy as they said they would.
            Have been told to wait now whilst they investigate. Its been a few days already so will chase them up in a couple of days.
            I asked about the loan charge issue and was told not to send anything in for now.

              Well the outcome is that's its my fault for not chasing up the letter of offer.
              Received a letter with a simple sorry for the error of not sending me a letter of offer and that I should of chased it before the deadline.
              Have now been told to go down the loan charge route.

              I have written to my MP a few days ago but no response as yet.
              Have also emailed HMRC stating I had other more stressful things to worry about like looking for work.

              Not much more I can think of doing apart of some sort of legal action but that will just cost more money and stress.

                I had a similar issue. Similar timeline, call to see if I had all I needed etc.,
                I confirmed I had agreed to settle, then I got my settlement details including TTP etc., All agreed and signed etc.,
                I have since started this plan with a lump sum and then increments etc.,

                However, I then received a letter to say I hadn't sent my SA on time, which was true I sent it end September 2020 as agreed.
                But they had also included a loan charge and I now had to pay this.

                I sent it onto my tax advisors who have subsequently sorted this issue.

                Long story short I just think yours (like mine) is a mix up at source.
                If you don't have a tax advisors then a call to them will probably suffice.

                  Do you know what your tax advisor had to do?

                    Go and find the number for WTT and see what they offer.

                    There is a big difference between the tax advice your typical accountant can give you and the advice you actually need which is very specialist.
