IR35: CALL FOR EVIDENCE - from public sector

We are starting to hear that some contractors who moved to payroll in the public sector, after April 2017, are being investigated by HMRC for historic IR35 taxes.

Is this you? If so, we would like to understand more information please..... this is key for the campaigning - particularly as HMRC claimed they would not investigate anyone if they moved to payroll at the same client.

    1. Did you agree to stay working for the client, and convert to working on payroll?

    2. Have you had an investigation by HMRC for tax years prior to April 2016?

If so, then please email us, in confidence, [email protected]

    According to HMRC :
"However, HMRC will not use information
resulting from these changes to open a new enquiry into earlier years unless there is reason
to suspect fraud or criminal behaviour."

But who is going to draw the line of "suspect fraud". For HMRC not paying tax for years could be fraud for them.

It's exactly why HMRC information is deliberately ambiguous & open to interpretation. So they can change the rules & move the goalposts at will, should they so desire.
If you don't have anything nice to say, say it sarcastically

Oh come on. ALL the regulars guessed this would happen the moment this move was announced. 2013 and all that...
