Hi

Does anyone know QDOS position if an end client through an SDA defines the role as Inside IR35? Do they say this invalidates the insurance? Especially if ROS is one of the reasons given?

Best to talk to them, but they certainly require a "reasonable prospect of success" and they could argue that there wasn't one, but it really depends whether the reality matches the client's opinion (on RoS, it probably does, unless you can show otherwise, but there are other factors than RoS). I think they would look at your case and decide. The client being against would be a negative for continuing with the case.

I think there will be a reasonable prospect of success in >90% of cases (it isn't there to catch you out, rather to avoid sunk costs). But you can ask QDOS directly.
