As far HMRC in concerned is it possible to take on role left by permie BA if they left becuse of illness, but still be outside IR35?

Take on role left by permie BA but outside IR35?

If the client assesses it as outside for any work beyond April, then why the heck not?
Before? I'd say it were a bit shifty. Are you able to prove you're not backfilling while they recruit? -

But, what you're suggesting here is about as strong an indicator as there could be that you'd be inside. What does the client say, as it'll be their decision from April onwards.If they say Inside, it doesn't really matter what anyone here thinks HMRC will say.Comment
