    Mileage

    Hi Folks,

I've taken up a new contract and would like some advice on mileage.

"Finance have advised that contractors working on the Scottish Courts project can claim for any mileage over and above 60 miles a day at 20p per mile. Should be submitted with daily breakdown with timesheet weekly."

    Is this legit?

    Many thanks,

    Johny

Yep, if you have to travel around several sites, it is indeed one of those rare cases where expenses are legit.

I don't think its for travelling between sites as that wouldn't start after 60 miles and would be 45p a mile from the moment you left the office.

So if it's for your commute journey expenses can be claimed but would be subject to tax - see Travel and subsistence expenses for workers engaged through 'employment intermediaries' from 6 April 2016 - GOV.UK for examples of what is and isn't allowed.

It's legit as it's in your contract but I don't think it's going to net you anything like you think it will as I don't think it's a tax free expense.

I read the post as client paying mileage for travel between sites after 60 miles. 1-59 miles tax deductible as per usual and 60 plus is recovered from the client.

Don't assume tax deductible - look at my link and start to see the complexities involved....

Better than a kick in the teeth. To be clear, if it is in a contract with his LtdCo it's simply an additional payment to his LtdCo. His personal arrangement with his LtdCo is subject to all the normal rules for travel.

Anything which is none standard at the moment I'm viewing as inside IR35 contract desperately trying to get people to sign up...

                Thanks

Thanks for your comments. Much appreciated.

This is the first time I've used my own vehicle as I generally use the works van.

20p a mile seems miserly, but yes, better than a kick in the teeth.

YourCo bills 20p per mile +VAT from ClientCo.

You then claim from YourCo according to HMRC rules.
