I was listening to the head of Pimlico on R4 this morning. He was absolutely certain that the guy supplying his own tools was an indication of self employment - because HMRC had told him so. The plumbers lawyer had won on right of substitution not being present. As I understood the reporting of course.
There are more similar cases pending, I understand.Comment

Happy to switch this to a new thread, but I don't know how to.
I think this is hugely significant for those who get deemed inside ir35. Basically means you get your day rate for (say) 25 days a year. That's a huge bonus right there and would ease the pain of being "caught".Comment

In regards to significance it really depends on your actual contract and how it works in practice.

He was a contractor on £80K (he could have been on £40K as an employee).
