I am currently contracting for a consultancy where I perform work for a few different clients. I can see this going on for longer than 2 years. Does this mean I fall inside of IR35 as my client is a consultancy despite me working for various final end-clients over different projects, different location etc. If there is no work for the consultancy I cant work either and dont get paid, so I am taking on a significant risk of being contracted in this way, so dont really see why I should be subjest to IR35

What Mal said but just as further clarrification you are confusing the 2 year rule (see the sticky at the top of the page) with IR35 (many threads on this and reading material on the links on the right of the page)
Some would argue in a very long contract the client can start to forget the difference between you as a contractor and a permie position but as long as your contract has been checked for all the items mentioned by Mal and you make sure your working conditions match you should be ok. Get your contract checked and correct but just as importantly, if not more so, make sure your working conditions stay as contracted. When it comes to an investigation they will look at your working conditions over your contract. If your contract has no direction from the client (as it shouldn't to be out of IR35) and you slip in to client directing working hours, asking him for time off, booking holidays and having them refused like a permie you are going to come unstuck.'CUK forum personality of 2011 - Winner - Yes really!!!!Comment

Thanks guys. Just googled some of those IR35 TLAs and working practices align with those. I do enjoy saying to the client "Wont be in tomorrow" instead of "Can I take tomorrow off"Comment

Me: I will be off these days
Him: You mean you would like to ask for these days holiday
Me: No, I mean I won't be in these days
Him: How do you know that it will be convenient
Me: I am the project manager and am taking these days as there will be a lull in the workload.
