      Not really, it's a judicial review of the decision not to have an inquiry into the legality or otherwise of the Iraq war, not into the legality or otherwise of the war itself. And it probably has a foregone conclusion.

        Thats not how I read Sparty old chap. It seems to say that the Govt. will have to show the decision to go to war was legal. Have I missed something or is the report itself misleading?

        BTW AndyW: Bliar is a common name used on here for he who must be stabbed do a search!

          It's overly dramatic BBC reporting, I'm afraid.

          The Court of Appeal ruled they were entitled to apply for a judicial review of the government's refusal to hold an independent inquiry

          As far as it goes for the government, they will just have to produce Lord Goldsmith's A4 piece of paper saying the war is legal.

                The judiciary is just upholding laws created by the Parliament, and it was the Parliament that voted for (thanks to support from Conservatives) start of war in Iraq, so Blair naturally washes his hands and no judges would be able to do anything. Even if Blair was not smart enough to get vote in Parliament then still matters of war is really in the hands of the executive, ie elected Govt that was present at the time.

                This case would have had only one chance if it was proven that Blair & Co misled Parliament and the Parliament withdraws forces and impeaches him, something that ain't going to happen.

                The lawyers are happy however.

                  I think there should be a period of consultation, as to whether a judicial review - into why there wasn't a public enquiry - is even considered.
