Why would HN be the determinant of the IR35 status? Especially for a public-sector client?

I would have thought they will just reflect exactly what the client demands.

The client is responsible for the determination. So assuming the client is the public sector end client and not another consultancy in between then worry not about it. It’s not your problem.

Harvey Nash told me "it's alright, it's outside of IR35 as it's less than two years - just opt out of these regulations"

Don't trust Harvey Nash. Or, to be frank, any agency.
