        But it was TalkTalk lack of security that allowed massive amount of customer data to fall in the hands of said scammers and make it profitable for them to mount a large scale operation focused on TalkTalk customers.

          Exactly this.

          The CEO/CIO did not put in place adequate security measures to ensure customer data was safe....

          They also made the decision to take the customer data out of the EU and all the interesting things that brings into scope purely to save money and make their bonuses......

          So actually they are completely culpable and should be tried as criminals.
