    IR35 Blankets coming from Agencies having advice from Umbrella providers

    I spoke with an agent about a role they said they took advice from the Umbrella that inside IR35 was less risk to them so they advertised accordingly. Problem is the end client did not have a blanket ban policy, the contract had not been drafted/ negotiated, no SOW and working conditions were not known. All that existed was a 1 page job spec and a advert so this doesnt even reach CEST stage. In my view the advertising stage is way too early to specify inside or outside unless there is a clear blanket ban policy coming from the client.

    if the agent recommended a specific umbrella you can bet your house on it, they have a self interest by receiving a fee from them or they are owner of said umbrella

      I am more concerned about the huge percentage of jobs Im seeing advertised as inside without I guess any tax specialist input or assuming the contractor will not negotiate contract, SOW, conditions etc. I accept some end clients have policies in place but the adverts seem to be over 80% stating inside status. Perhaps we are doomed to follow the construction industry model.

        Why is an agency asking an UmbrellaCo for IR35 status advice? It is a bit like asking your butcher whether you should go vegetarian.
        It sounds like the agency don't have a clue (they won't be alone).
        His heart is in the right place - shame we can't say the same about his brain...
